Purpose:
The Hamilton County Earthworks Program Board of Appeals shall hear and decide appeals where it is alleged that there is an error in any order, requirement, decision, or determination of an administrative officer of Hamilton County, Ohio, empowered to enforce these Earthwork Regulations, or any resolution, or part thereof, adopted pursuant thereto;
- The integrity of the hillside and potential for slippage or landslides;
- The danger to life and property due to hillside slippage and erosion for the proposed development;
- The impact of grading, clearing, or cut & fill activities on adjoining properties and receiving streams;
- The protection of adjacent property against damages from sediment runoff due to clearing and grubbing of land.
Establishing Authority:
Ohio Revised Code, Section 307.79, and Board of County Commissioners (BOCC) Resolution for the Establishment of the Hamilton County Local Board of Earthworks Appeals, established June 8, 2005.
Composition:
Five members shall be appointed for five-year terms, in such a way that the terms of one (1) member shall expire each year. For purposes of organizing the initial Board, members shall be appointed for 1 yr.; 2 yr.; 3 yr.; 4 yr.; and 5 yr. terms. Each member shall hold office from the date of appointment until the end of the term for which the member was appointed. Any member appointed to fill a vacancy occurring before the expiration of the term for which the predecessor was appointed shall hold office for the remainder of that term. Any member shall continue in office subsequent to the expiration date of the term for which the member was appointed, or until a successor takes office, or until sixty (60) days have elapsed, whichever occurs first. One (1) member shall be a Registered Professional Civil Engineer experienced in hydrology &/or land development. One (1) member shall be a Registered Professional Civil Engineer specializing in Geotechnical Engineering. One (1) member shall be an Attorney-at-law admitted into the bar of the State of Ohio. One (1) member shall be a Contractor trained and experienced in Erosion and Sediment Control. One (1) member shall be a representative of the Ohio Valley Development Council.
